Terms of Membership.
1. Agreement
These Terms of Membership ("Terms") are an agreement between you and the operator of The Meme FOMO Clan ("the Clan", "we", "us"). They apply to this website, the clan Discord server, the AI meme radar, alerts, calls, playbooks, competitions, clan launches and anything else we provide (the "Services"). Our Risk Disclosure and Privacy Policy are part of these Terms.
By using the Services, starting a trial, paying for a membership or joining the clan Discord, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You must be legally allowed to use the Services and to trade crypto assets where you live. You are responsible for knowing and following your local laws, including tax laws.
- You may not use the Services if you are subject to sanctions or located in a sanctioned or embargoed country or region.
- One membership is for one person. You may not share, resell or transfer your access.
3. Not financial advice
The Services are for education and entertainment only. Nothing we provide is financial, investment, trading, legal or tax advice, or a recommendation to buy, sell or hold anything. We are not registered investment advisers, brokers or fiduciaries. You alone decide what to trade and you alone bear the results, including total loss. Please read the full Risk Disclosure.
4. Membership, trial and billing
- Trial. Your first 30 days cost $1 (USD). Unless you cancel before the trial ends, your membership renews automatically at $39 per month, charged to the payment method you provided, every month until you cancel.
- Founding price. The first 100 members keep the $39 monthly price for as long as their membership stays active without a break. If you cancel and rejoin later, the price in effect at that time applies.
- Cancel any time. You can cancel through the link in your payment receipt or customer portal, or by asking us in the clan Discord. Cancellation stops future charges. You keep access until the end of the period you already paid for.
- Refunds. Payments are non-refundable, including for partial months and unused time, except where the law requires otherwise. If you think you were charged by mistake, contact us within 14 days and we will review it in good faith.
- Price changes. We may change prices for future periods with at least 14 days' notice. Changes never apply to a period you have already paid for.
- Payments are processed by third-party providers. We do not receive or store your full card number. Taxes may apply depending on where you live.
- Failed payments may pause or end your access.
5. Clan rules
The clan works because people can trust it. You agree not to:
- Coordinate or promote pump-and-dump schemes, wash trading, spoofing or any other market manipulation.
- Promote a token you were paid to promote without clearly disclosing it, or run scams, phishing, fake giveaways or impersonation.
- Ask members for money, private keys, seed phrases or passwords, or send unsolicited direct messages offering trades or "opportunities".
- Dox anyone: share or seek another person's real name, address, workplace, photos, wallet ownership or other personal information without their consent.
- Harass, threaten, or post hateful, sexual or illegal content.
- Copy, record, resell or leak members-only content, alerts or calls outside the clan.
- Scrape, attack, overload or try to break the Services.
We may remove content, mute, suspend or ban anyone who breaks these rules, without a refund where the break is serious. Moderation decisions are ours to make.
6. Clan launches
From time to time the community may create meme tokens on third-party launch platforms. Every clan launch is a fair launch with no presale. Taking part is optional and at your own risk. We do not sell tokens, and a clan launch is not an investment offering, a promise of profit or a claim on any business. Tokenized stock rewards are not shares and carry no shareholder rights. Rewards depend on trading activity and third-party platforms, and can shrink or stop. See the Risk Disclosure, section 7.
7. Third-party services
The Services point to and rely on products we do not own or control, including the fomo app, Discord, payment processors, GeckoTerminal, StonkFun, Apple's App Store and Google Play. Your use of them is governed by their own terms and privacy policies. We are not responsible for their availability, fees, security, data or actions. We are an independent community and are not affiliated with or endorsed by any of them.
Referral disclosure: we may earn a commission from fomo when you sign up or trade through our link.
8. Content
The website, playbooks, radar, designs and other materials we create belong to us. You may use them for your own personal, non-commercial learning while your membership is active. Anything you post in the clan stays yours, but you give us a free, worldwide license to display, store and share it within the Services. Do not post anything you do not have the right to share.
9. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, availability and non-infringement. Market data, scores, alerts and calls may be late, incomplete or wrong. We do not guarantee any result, profit, reward, uptime or that the Services will be error-free.
10. Limitation of liability
To the fullest extent the law allows:
- We, our organizers, moderators and contributors are not liable for any trading losses, lost profits, lost tokens or funds, missed opportunities, or any indirect, incidental, special, consequential or punitive damages, however caused, even if we were told they were possible.
- Our total liability for any claim relating to the Services is limited to the amount you paid us in the three months before the claim arose.
Some places do not allow certain limits on liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity. You agree to cover any claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Services or your violation of any law or anyone else's rights.
11. Ending your membership
You can stop using the Services and cancel at any time (see section 4). We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the Services. If we end the Services entirely for reasons other than your breach, we will stop future billing. Sections 3, 6, 8, 9, 10 and 12 survive after your membership ends.
12. Disputes and changes
If you have a problem, please raise it with us first in the clan Discord so we can try to fix it informally. Any claim must be brought individually, not as part of a class or representative action, to the extent the law allows. These Terms are governed by the laws of the place where the operator of the Clan is established, without regard to conflict-of-law rules, except where the consumer protection laws of your country give you rights that cannot be waived.
We may update these Terms. When we make a material change we will post the new version here with a new effective date and, for members, announce it in the clan Discord. Continuing to use the Services after a change means you accept it. If a part of these Terms is found unenforceable, the rest still applies. These Terms are the whole agreement between you and us about the Services.
